Daf 141b (דַּף קמ״א ע״ב)

The Fifth Tikkun (תִּקּוּנָא חֲמִישָּׁאָה)

This is the Twenty-Sixth Tikkun (זֶהוּ תִּקּוּן כ״ו)

Bereshit: “For by fire Hashem will judge” (Isaiah 66) (בְּרֵאשִׁית כִּי בָאֵשׁ יהו״ה נִשְׁפָּט), Elohim-the Master of Judgment (אלהי״ם מָארֵי דְּדִינָא). And concerning this it is said, “You shall not curse Elohim” (Exodus 22) (וַעֲלֵיהּ אִתְּמַר אֱלֹהִים לֹא תְקַלֵּל). Surely, as it is said above, “For Elohim is Judge, He lowers one and raises another” (Psalms 75) (בְּוַדַּאי כְּמָה דִלְעִילָא אִתְּמַר כִּי אֱלֹהִים שֹׁפֵט זֶה יַשְׁפִּיל וְזֶה יָרִים), so must he be a judge below, lowering one in judgment and raising another (כַּךְ אִיהוּ צָרִיךְ לְמֶהֱוִי דַיָּינָא לְתַתָּא, לְדָא יַשְׁפִּיל בְּדִינָא וּלְדָא יָרִים), according to their deeds (כְפוּם עוֹבָדוֹי). To one he inclines toward Chesed (לְדָא מַטֶּה כְּלַפֵּי חֶסֶד), to one toward Gevurah (לְדָא כְּלַפֵּי גְבוּרָה), truth in the middle (אֱמֶת בְּאֶמְצָעִיתָא). And because of this he is called a true judge (וּבְגִין דָּא אִתְקְרֵי דַּיָּין אֱמֶת). Elohim is the throne in calculation (אלהי״ם הַכִּסֵּ״א בְּחוּשְׁבָּן), for there are Y״H, which are Chokhmah and Binah (דְּתַמָּן י״ה דְּאִיהִי חָכְמָה וּבִינָה). “This is My Name”-with Y״H, 365 from the side of the left (זֶה שְּׁמִי עִם י״ה שְׁס״ה מִסִּטְרָא דִשְׂמָאלָא).

And this Y״H is from Elohim (וְדָא י״ה מִן אלהי״ם), upon, the Nukvah (ה׳ עַל י׳ נוּקְבָא). And when the judge judges, he must sit and the litigants stand (וְכַד דַּיָּין אִיהוּ דָן, צָרִיךְ לְמֶהֱוִי אִיהוּ יָתֵיב וּבַעֲלֵי דִינָא קַיְימִין), in likeness of above, as it is said of Kudsha Berikh Hu, “And the sons of Elohim came to stand before Hashem” (Job 1) (כְגַוְונָא דִלְעִילָא, דְאִתְּמַר בְּקוּדְשָׁא בְּרִיךְ הוּא וַיָּבֹאוּ בְּנֵי הָאֱלֹהִים לְהִתְיַצֵּב עַל יהו״ה). He is seated (אִיהוּ יָתֵיב), and they are standing to request judgment (וְאִינוּן קַיְימִין לְמִתְּבַע דִּינָא). And because Satan enters among them to demand the sins of the children of Yisrael (וּבְגִין דְּשָׂטָן יֵעוּל בֵּינַיְיהוּ לְמִתְּבַע חוֹבֵיהוֹן דִּבְנֵי יִשְׂרָאֵל), they are placed upon him (אִינוּן בְּמַטּוּלָא עֲלֵיהּ), until he judges them. And this is “to stand before Hashem” (עַד דַּהֲוָה דָן לְהוֹן וְדָא אִיהוּ לְהִתְיַצֵּב עַל יהו״ה).

And further, “to stand before Hashem”-to ask and to request judgment from Kudsha Berikh Hu (וְעוֹד לְהִתְיַצֵּב עַל יהו״ה, לְשַׁאֲלָא וּלְמִתְּבַע דִּינָא לְגַבֵּי קוּדְשָׁא בְּרִיךְ הוּא). Hashem, when He leads the world with mercy (יהו״ה, כַּד נָהִיג עָלְמָא בְּרַחֲמִין), the accusers demand judgment (וּמְקַטְרְגִין וְתָבְעִין דִּינָא). And this is “to stand before Hashem” (וְדָא אִיהוּ לְהִתְיַצֵּב עַל יהו״ה). And furthermore, “to stand before Hashem”-Hashem is the central pillar (וְתוּ לְהִתְיַצֵּב עַל יהו״ה, יהו״ה עַמּוּדָא דְאֶמְצָעִיתָא). They ask and demand judgment from Gevurah, the great court, which stands upon the central pillar (דְשָׁאֲלִין וְתָבְעִין דִּינָא מִגְּבוּרָה בֵּי דִינָא רַבְרְבָא, דְקַיְימָא עַל עַמּוּדָא דְאֶמְצָעִיתָא). And this is “upon Hashem” (וְדָא הוּא עַל יהו״ה). Regarding the drawing of judgments before Gevurah it is said, “to stand before Hashem” (עַל דִּמְקָרְבִין דִּינִין קֳדָם גְּבוּרָה אִתְּמַר בְּהוֹן לְהִתְיַצֵּב עַל יהו״ה). And even though His children are Yisrael, He has no permission to transgress judgment (דְאַף עַל גַּב דְּבְנוֹי אִינוּן יִשְׂרָאֵל לֵית לֵיהּ רְשׁוּ לְאַעֲבָרָא עַל דִּינָא), for the Orayta is given in judgment (דְּאוֹרַיְיתָא בְּדִינָא אִתְיְיהִיבַת), and He swore upon it not to transgress it (וְאוֹמֵי עֲלָהּ דְּלָא יַעֲבַר עֲלָהּ). And concerning judgment, Gevurah is in the middle, Chesed at the right, and the central pillar at the left (וּלְגַבֵּי דִינָא גְּבוּרָה אִיהִי בְּאֶמְצָעִיתָא, וְחֶסֶד מִימִינָא, וְעַמּוּדָא דְאֶמְצָעִיתָא מִשְּׂמָאלָא). And all judgments hang from this place (וְכָל דִּינִין מֵהַאי אֲתַר תַּלְיָין), and all the Sefirot are called judgments, Gevurah-even Hashem (וְכָל סְפִירָן כֻּלְּהוּ אִתְקְרִיאוּ דִינִין גְּבוּרָה וַאֲפִילוּ יהו״ה).

The first judgment is one that is called judgment of strangulation (דִּינָא קַדְמָאָה חֲדָא אִתְקְרֵי דִין לָדוּן בְּחֶנֶק). And it is said, “You shall not leave his corpse upon the tree” (Deuteronomy 21) (וְאִתְּמַר לֹא תָלִין נִבְלָתוֹ עַל הָעִץ). Rabbi El'azar, my son, said to him (אָמַר לֵיהּ אֶלְעָזָר בְּרִי), here we must renew words (הָכָא צָרִיךְ לְחַדְּשָׁא מִלִּין): there is a tree and a tree (אִית עִץ וְאִית עִץ). This is what is written, “For man is a tree of the field” (Deuteronomy 20) (הֲדָא הוּא דִכְתִיב כִּי הָאָדָם עִץ הַשָּׂדֶה). And there is a man who is the Tree of Knowledge of Good and Evil (וְאִית אָדָם דְּאִיהוּ עִץ הַדַּעַת טוֹב וָרָע). And the guilt of man is his corpse-Adam Kadma’ah, who is the Tree of Life (וְחוֹבָא דְאָדָם אִיהִי נִבְלָתוֹ דְאָדָם קַדְמָאָה דְאִיהִי עִץ הַחַיִּים). This sin must not be hung upon it (לָא צָרִיךְ לְתַלְיָיא בֵיהּ חוֹבָא דָא). This is what is written, “You shall not leave his corpse upon the tree” (Deuteronomy 21) (הֲדָא הוּא דִכְתִיב לֹא תָלִין נִבְלָתוֹ עַל הָעִץ). For whoever eats from His tree, which is the Tree of Life, it is said of him, “and eat and live forever” (Bereshit 3) (דְּמָאן דְּאָכַל מֵעִץ דִּילֵיהּ דְאִיהוּ עִץ הַחַיִּים, אִתְּמַר בֵּיהּ וְאָכַל וָחַי לְעוֹלָם). And further, “You shall not leave his corpse upon the tree” (וְעוֹד לֹא תָלִין נִבְלָתוֹ עַל הָעִץ): the tree here is the Torah scholars who labors in the Orayta, which is the Tree of Life (עִץ דְּהָכָא דָא תַלְמִיד חָכָם דְּאִשְׁתַּדַּל בְּאוֹרַיְיתָא דְּאִיהִי עִץ הַחַיִּים). This is what is written, “It is a tree of life to those who hold fast to it” (Proverbs 3) (הֲדָא הוּא דִכְתִיב עִץ חַיִּים הִיא לַמַּחֲזִיקִים בָּהּ). Do not let his corpse remain on it-that is, the sin that he sinned by day, do not let it remain with him by night (לֹא תָלִין בּוֹ נִבְלָתוֹ, דְאִיהִי חוֹבָה דְּחָב בְּיוֹמָא לֹא תָלִין עִמֵּיהּ בַּלַּיְלָה).

For immediately he should return in repentance (דְּמִיָּד יְתוּב בִּתְיוּבְתָּא), as the Masters of the Mishnah have established: “If you see a Torah scholar who sinned during the day, do not harbor suspicion against him at night, for surely he has repented” (כְּמָה דְאוּקְמוּהָ מָארֵי מַתְנִיתִין אִם רָאִיתָ תַּלְמִיד חָכָם שֶׁחָטָא בַּיּוֹם אַל תְּהַרְהֵר אַחֲרָיו בַּלַּיְלָה, דְוַדַּאי עָשָׂה תְּשׁוּבָה) (Some say: perhaps he repented, but you might have thought so; therefore say: surely he repented [נ״א שמא עשה תשובה, שמא סלקא דעתך, אלא אימא ודאי עשה תשובה]). And further, “You shall not leave his corpse upon the tree” (וְעוֹד לֹא תָלִין נִבְלָתוֹ עַל הָעִץ): this is the Torah scholar (דָּא תַּלְמִיד חָכָם). His “corpse”-this is the daughter of the ignoramus, who is a creeping thing (נִבְלָתוֹ דָּא בַּת עַם הָאָרֶץ דְּאִיהִי רִיחֲשָׁא). If you hang her upon him, either he buries her or she buries him (דְאִם אַנְתְּ תַּלְיָא לָהּ בֵּיהּ, אוֹ קוֹבְרָהּ אוֹ קוֹבְרָתוֹ). And this is, “You shall surely bury him” (Deuteronomy 21) (וְדָא אִיהוּ כִּי קָבוֹר תִּקְבְּרֶנּוּ): either he buries her, or she buries him (כִּי קָבוֹר הוּא לָהּ אוֹ תִּקְבְּרֶנּוּ אִיהִי לֵיהּ). And such a woman is not called his Zivug and union (וְאִתְּתָא דָא לַאו אִקְרֵי זִוּוּגָא וְיִחוּדָא דִילֵיהּ), but she is as a curse hanging upon him (אֶלָּא אִיהִי כְּמַטּוּלָא תַלְיָא עֲלֵיהּ), like a serpent bound upon his neck (כְּחִוְיָא קָשִׁיר עַל קְדָלֵיהּ). And because of this: “For he that is hanged is a curse of Elohim” (Deuteronomy 21) (וּבְגִין דָּא כִּי קִלְלַת אֱלֹהִים תָּלוּי), for she is a curse, who either kills him or brings him to poverty (דְּאִיהִי קְלָלָה, דְקַטִּילַת לֵיהּ אוֹ אַיְיתֵי לֵיהּ לִידֵי עֲנִיּוּתָא).

Another matter: “You shall not leave his corpse upon the tree” (דָבָר אַחֵר לֹא תָלִין נִבְלָתוֹ עַל הָעִץ)-this is Shabbat (דָּא שַׁבָּת), in which a man inherits an extra Neshama (דְּיָרִית בֵּיהּ בַּר נַשׁ נְשָׁמָה יְתֵירָה). He must not let appear before it the soul that rules a man during the weekdays, in labor which is forbidden on Shabbat (לָא צָרִיךְ לְאִתְחַזְיָא קֳדָמָהָא נַפְשָׁא דְשָׁלְטָא בְּבַר נַשׁ בְּיוֹמִין דְּחוֹל, בִּמְלָאכָה דְאִיהִי אֲסוּרָה בְשַׁבָּת). Rather, “You shall surely bury him on that day” (Deuteronomy 21) (אֶלָּא קָבוֹר תִּקְבְּרֶנּוּ בַּיּוֹם הַהוּא), that it not appear before “Remember” and “Guard” of Shabbat (דְלָא אִתְחַזְיָא קֳדָם זָכוֹר וְשָׁמוֹר דְּשַׁבָּת). And concerning it, it is said, “Remove your shoes from your feet, for the place on which you stand is holy ground” (Exodus 3) (וּבְגִינָהּ אִתְּמַר שַׁל נְעָלֶיךָ מֵעַל רַגְלֶיךָ כִּי הַמָּקוֹם אֲשֶׁר אַתָּה עוֹמֵד עָלָיו אַדְמַת קֹדֶשׁ הוּא). “And you shall not defile your land” (Deuteronomy 21) (וְלֹא תְטַמֵּא אֶת אַדְמָתְךָ)-for the extra Neshama is the supernal Eretz Yisrael, holy land (דְנִשְׁמָתָא יְתֵירָה אִיהִי אֶרֶץ יִשְׂרָאֵל דִלְעִילָא, אַדְמַת קֹדֶשׁ), of which it is said, “Yisrael is holy to Hashem” (Jeremiah 2) (דְּאִתְּמַר בָּהּ קֹדֶשׁ יִשְׂרָאֵל לַיהו״ה).
