Daf 143a (דַּף קמ״ג ע״א)
And there are sins of which it is said, “He seals up the hand of every man” (Job 37) (וְאִית חוֹבִין דְּאִתְּמַר בְּהוֹן וּבְיַד כָּל אָדָם יַחְתּוֹם), and they show her the seal of her hand (וּמַרְאִין לָהּ חֲתִימַת יְדָהָא). And there are sins that are on condition, for which he stipulated to pay them in this world (וְאִית חוֹבִין דְּאִינוּן עַל תְּנַאי דְּאַתְנֵי עֲלֵיהּ לְפָרְעָא לוֹן בְּהַאי עָלְמָא), sins of his place (דְחוֹבִין דִּילֵיהּ בְּאַתְרֵיהּ), for the claimant collects them only in his place (דְּלָא יִגְבַּהּ לוֹן תּוֹבֵעַ אֶלָּא בְּאַתְרֵיהּ). And these are the sins of twenty years (וְאִלֵּין אִינוּן חוֹבִין דְּעֶשְׂרִין שְׁנִין). And there are sins below (וְאִית חוֹבִין לְתַתָּא), for the ancients established that until twenty years, punishment is below and not above (דְאוּקְמוּהוּ קַדְמָאִין דְּעַד עֶשְׂרִין שְׁנִין מַעֲנִישִׁין לְתַתָּא וְלָא לְעִילָא). And there are sins that are punished above, and they are demanded above in the great court (וְאִית חוֹבִין דְּמַעֲנִישִׁין לְעִילָא וְתָבְעִין לוֹן לְעִילָא בֵּי דִינָא רַבְרְבָא), and because of them the Neshama is pledged above (וּבְגִינַיְיהוּ מְמַשְׁכְּנִין נִשְׁמָתָא לְעִילָא), and they do not let her descend below (וְלָא מַנִּיחִין לָהּ לְנָחֲתָא לְתַתָּא).
But with sins that are punished below, she is not punished above (אֲבָל בְּחוֹבִין דְּמַעֲנִישִׁין עֲלַיְיהוּ לְתַתָּא, לָא מַעֲנִישִׁין לָהּ לְעִילָא), and they do not detain her there (וְלָא מְעַכְּבֵי לֵיהּ תַּמָּן). And there are sins of the Neshama that are collected everywhere (וְאִית חוֹבִין דְּנִשְׁמָתָא דְּגָבִין מִנַּיְיהוּ בְּכָל אֲתַר), such as “He who curses his father and his mother shall surely be put to death” (Exodus 21) (כְּגוֹן וּמְקַלֵּל אָבִיו וְאִמּוֹ דְּאִתְּמַר בֵּיהּ מוֹת יוּמָת), from the court above and from the court below (מִבֵּי דִינָא דִלְעִילָא וּמִבֵּי דִינָא דִלְתַתָּא). She is judged with two courts (דְּאִתְדַּנַּת בִּתְרֵין דִּינִין), and because of this sin, wherever they find her above, they collect from her (וּבְגִין חוֹבָא דָא בְּכָל אֲתַר דְּאַשְׁכְּחִין לָהּ לְעִילָא גָבִין מִינָהּ), and wherever they find her below, they collect from her (וּבְכָל אֲתַר דְּאַשְׁכְּחִין לָהּ לְתַתָּא גָבִין מִינָהּ). And there is no commandment that does not have permission to protect her (וְלֵית פִּקּוּדָא דְלֵית לָהּ רְשׁוּ לְאַגָּנָא עֲלָהּ).
For there are sins that are judged with harsh judgments upon the Neshama (דְּאִית חוֹבִין דְּדַיְינִין לָהּ בְּדִינִים חֲמוּרִים לְנִשְׁמָתָא), and then a mitzvah comes, which is the Matronita, such as the mitzvah of Tefillin (וְיֵתֵי מִצְוָה דְאִיהִי מַטְרוֹנִיתָא כְּגוֹן מִצְוַת תְּפִלִּין), and she shields over her and spreads her wings upon her (וְאַגִּינַת עֲלַיָּהּ וּפְרִישַׂת גַּדְפָהָא עֲלָהּ), and the accuser has no permission to draw near there (וְלֵית רְשׁוּ לִמְקַטְרֵג לְקָרְבָא תַּמָּן). And there are sins over which the Matronita has no permission to shield (וְאִית חוֹבִין דְּמַטְרוֹנִיתָא לֵית לָהּ רְשׁוּ לְאַגָּנָא עֲלַיְיהוּ). This is what is written, “From My altar you shall take him, to die” (Exodus 21) (הֲדָא הוּא דִכְתִיב מֵעִם מִזְבְּחִי תִּקָּחֶנּוּ לָמוּת). But there are commandments which are maidservants (אֲבָל פִּקּוּדִין אִית דְּאִינוּן שְׁפָחוֹת), from those commandments that are performed on condition of receiving a reward (מֵאִלֵּין פִּקּוּדִין דְּאִינוּן עַל מְנָת לְקַבֵּל פְּרָס). Even though they come to shield over her, the accusers take them under their authority (אַף עַל גַּב דְּיֵיתוּן לְאַגָּנָא עֲלָהּ, נָטְלֵי לוֹן מְקַטְרְגִין תְּחוֹת רְשׁוּתַיְיהוּ) (Some say: the accusers take them out from under their authority [נ״א נפקין לה מקטרגין מרשותייהו]). And there are other sins called “divided judgments” (וְאִית חוֹבִין אָחֳרָנִין דְּאִתְקְרִיאוּ חֲלוּקֵי דַּיָּינִין), for sins over which they are divided (עַל חוֹבִין דְּחוֹלְקִין בְּהוֹן). From them, some incline toward Chesed and judge the Neshama with money, which are civil judgments (מִנְּהוֹן מַטֶּה כְּלַפֵּי חֶסֶד, וְדַיְינִין לָהּ לְנִשְׁמָתָא בְּמָמוֹן דְּאִיהוּ דִינֵי מָמוֹנוֹת). And there are others who disagree and incline toward guilt, to judge her with capital judgments (וְאִית אָחֳרָנִין דְּחוֹלְקִין עֲלַיְיהוּ וְאִינוּן נוֹטִין כְּלַפֵּי חוֹבָה, לְמֵידַן לָהּ בְּדִינֵי נְפָשׁוֹת). If merits prevail over sins, they judge her with civil judgments and collect from her merits, which are acts of kindness (אִם זַכְוָון מִתְגַּבְּרִין עַל חוֹבִין דָּנִין לָהּ בְּדִינֵי מָמוֹנוֹת, וְגָבִין מִזַּכְוָון דְּאִינוּן גְּמִילוּת חֲסָדִים דִילֵיהּ). And if sins prevail, they judge her with capital judgments from the side of Gevurah, and they collect from her Nefesh and Ruach (וְאִם חוֹבִין מִתְגַּבְּרִין דַּיְינִין לָהּ בְּדִינֵי נְפָשׁוֹת מִסִּטְרָא דִגְבוּרָה, וְגָבִין בָּהּ נֶפֶשׁ וְרוּחַ). And above there is no favoritism between the innocent and the guilty (וּלְעִילָא לֵית מַשּׂוֹא פָּנִים בֵּין זַכָּאָה לְחַיָּבַיָּא), and so it must be equalized below, regarding judgment of the innocent with the guilty (וְכֵן צָרִיךְ לְהַשְׁווֹת לְתַתָּא גַבֵּי דִינָא זַכָּאָה עִם חַיָּיבָא), from the side of Truth, the central pillar (מִסִּטְרָא דֶאֱמֶת עַמּוּדָא דְאֶמְצָעִיתָא). And the judge must not show favoritism to one of them in judgment (וְלָא יְהֵא דַיָּינָא רַשַּׁאי לְמֶעֱבַד מַשּׂוֹא פָנִים לְחַד מִנַּיְיהוּ בְדִינָא). For regarding the Judge above it is said, “He shows no favoritism nor takes a bribe” (Deuteronomy 10) (דִבְדַיָּינָא דִלְעִילָא אִתְּמַר בֵּיהּ לֹא יִשָּׂא פָנִים וְלֹא יִקַּח שֹׁחַד).
Woe to the judge below who differs from the Judge above (וַוי לֵיהּ לְדַיָּינָא לְתַתָּא דְאִשְׁתַּנֵּי מִדַּיָּינָא דִלְעִילָא), for he denies the works of Bereshit (דְאַכְחִישׁ עוֹבָדָא דִבְּרֵאשִׁית). And he must not say, this one is trustworthy more than that one (וְלָא יֵימָא דָא מְהֵימְנָא מִדָּא). For just as it is below, “Judges and officers you shall appoint for yourself in all your gates” (Deuteronomy 16) (דִּכְמָה דְאִיהוּ לְתַתָּא שׁוֹפְטִים וְשׁוֹטְרִים תִּתֶּן לְךָ בְּכָל שְׁעָרֶיךָ), for judgment of bodies (לְדַיְינָא גוּפִין), so it is above, judges and officers for judgment of the Neshama (הָכִי אִית לְעִילָא שׁוֹפְטִים וְשׁוֹטְרִים לְדַיְינָא נִשְׁמָתָא). And he must not honor this one more than that one, but both must be equalized in judgment (וְלָא יוֹקִיר לְדָא יַתִּיר מִדָּא, אֶלָּא תַרְוַיְיהוּ בְּהַשְׁוָאָה בְדִינָא). And they must wait before the judge (וְאִינוּן צְרִיכִין לְמִשְׁמַע קֳדָם דַּיָּינָא), and not speak until the judge asks them and gives them permission to speak (וְלָא יְמַלְּלוּן עַד דְּשָׁאִיל לוֹן דַּיָּינָא, וְיָהִיב לוֹן רְשׁוּ לְמַלְּלָא). And they must stand before him in awe (וִיהוֹן קֳדָמֵיהּ בִּדְחִילוּ), because the Shekhinta rests upon them (בְּגִין דִּשְׁכִינְתָּא שַׁרְיָא עֲלַיְיהוּ). And whoever demands justice is as if he sustains in the world the Judge of Truth (וּמָאן דְּתָבַע קְשׁוֹט כְּאִלּוּ מְקַיֵּים עַל עָלְמָא דַיָּין אֱמֶת) (Some say: true judgment [ס״א דין אמת]). All the more so, one who judges a true judgment, it is as if he sustains, “Truth shall spring out of the earth” (Psalms 85) (וְכָל שֶׁכֵּן מָאן דְּדָן דִּין אֱמֶת, כְּאִלּוּ מְקַיֵּים אֱמֶת מֵאֶרֶץ תִּצְמָח). Woe to him who establishes falsehood and casts down truth (וַוי לֵיהּ לְמָאן דְּאוֹקִים שִׁקְרָא וְאַפִּיל אֱמֶת), for he causes, “And truth was cast to the ground” (Daniel 8) (דְּגָרִים וְתַשְׁלֵךְ אֱמֶת אַרְצָה). And who causes this? A judge who does not judge true judgment (וּמָאן גָּרִים דָּא דַּיָּינָא דְלָא דָן דִּין אֱמֶת). And surely a judge who judges true judgment is as if he brings out the Shekhinta and Yisrael from exile, and establishes them upon the earth (וּבְוַדַּאי דַּיָּין דְּדָן דִּין אֱמֶת כְּאִלּוּ הוּא אַפִּיק לִשְׁכִינְתָּא וּלְיִשְׂרָאֵל מִגָּלוּתָא, וְאוֹקִים לוֹן מֵאַרְעָא).
Rabbi Shimon stood upon his feet (קָם רַבִּי שִׁמְעוֹן עַל רַגְלוֹי), and raised his hands toward above (וְסָלִיק יְדוֹי לְגַבֵּי עִילָא), and praised the Master of the world (וְשַׁבַּח לְמָארֵי עָלְמָא). And he said, “Master of the world, act for the sake of the Shekhinta who is in exile” (וְאָמַר, רִבּוֹן עָלְמָא עֲבֵיד בְּגִין שְׁכִינְתָּא דְאִיהִי בְגָלוּתָא). “And if she is bound, behold Abba and Imma, which are Chokhmah and Binah, can bring release” (וְאִם אִיהִי בְּאוֹמָאָה הָא אַבָּא וְאִמָּא דְאִינוּן חָכְמָה וּבִינָה יָכְלִין לְמֶעֱבַד הַתָּרָה). This is what is written, “Hashem Tzevaot has planned, and who can annul it?” (Isaiah 14) (הֲדָא הוּא דִכְתִיב יהו״ה צְבָאוֹת יָעָץ וּמִי יָפֵר). If the disciple could annul what the master has decreed (אִם הַתַּלְמִיד אוֹמֵי הָרַב יָכִיל לְמֶעֱבַד הַתָּרָה).
